A company is again challenging Haverford Township’s zoning ordinance that excludes billboards in the township.

According to Jim Byrne, township solicitor, an application has been filed by Delaware County Outdoor LLC with a P.O. Box address in Malvern.

The “substantive validity challenge” is on the basis that the zoning ordinance “unlawfully excludes commercial off-premises advertising billboards.”

The challenge is for 1200 and 510-534 West Chester Pike, of which DC Outdoor is a lessee.

Byrne told Haverford Patch that it is the same challenge as the one filed by the Bartkowski Investment Group, which is still in the Delaware County Court of Common Pleas. DC Outdoors is under management by Thaddeus Bartkowski, according to the Delaware News Network.

“We don’t think they’re safe at any height,” Byrne said, adding that he would review the application and that there will be a hearing on it.
